Acceptance of Terms

By downloading, installing, or using the Treasure Me app ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.

These Terms form a legally binding agreement between you and Camilla Sadyrova ("we", "us", or "Treasure Me"). Apple Inc. is not a party to these Terms but may enforce them as a third-party beneficiary to the extent applicable under its App Store Review Guidelines.

Description of Service

The App is intended for personal wardrobe organisation only. It does not constitute fashion advice, financial advice, insurance appraisal, or jewellery valuation services. AI-generated tags, outfit suggestions, colour analysis results, and jewellery valuations are provided as a convenience and may not always be accurate.

Free Trial and Subscriptions

3.1 Free Trial

A free trial period may be offered for new subscribers. The duration and available features during the trial will be displayed at the time of subscription. After the trial period ends, you will be charged the applicable subscription fee unless you cancel before the trial ends.

3.2 Subscription Terms

• Treasure Me may offer monthly, annual, or lifetime subscription options. Current pricing is displayed within the App at the time of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the confirmed purchase price.
• You can manage and cancel your subscription at any time in your Apple ID Account Settings.
• Cancellation takes effect at the end of the current billing period; you retain access to premium features until that date.

3.3 Payments and Refunds

All payments are processed by Apple through the App Store. Treasure Me does not handle payment information directly. Refund requests must be submitted to Apple and are subject to Apple's refund policy.

3.4 Price Changes

We reserve the right to change subscription prices. If a price increases, we will notify you in advance through the App or by email. Continued use after the notice period constitutes acceptance of the new price.

User Accounts

Using Treasure Me requires creating an account with a valid email address and password, authenticated via Supabase. You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.
• Notifying us promptly at camilabs.au+treasureme@gmail.com if you become aware of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in abusive behaviour, or are used for unauthorised purposes.

Your Content — Images and Data

By uploading images to the App, you confirm that:

• You own the images or have the right to upload them.
• The images do not contain personal data of other people without their consent (e.g. photos including other individuals' faces or identifying information).
• The images do not violate any applicable law or third-party intellectual property rights.

Your wardrobe data, jewellery records, outfit compositions, wear logs, joy ratings, and storage location assignments belong to you. We provide tools to manage and delete this data at any time.

AI Features Disclaimer

AI-generated results — including item tags, colour season classification, outfit suggestions, and jewellery identification — are provided as a convenience and may not always be accurate. You are solely responsible for reviewing, confirming, and correcting all item data within the App.

Treasure Me does not guarantee the accuracy, completeness, or fitness for any particular purpose of AI-generated content. We continuously update and switch AI models to improve quality; results may vary over time as models change.

6.1 GoodBuy Check

Jewellery Valuation Disclaimer

Treasure Me is not a licensed jewellery appraiser, insurance provider, or financial adviser. Vault valuations:

• Should not be used as the basis for insurance coverage decisions without independent professional appraisal.
• Should not be relied upon for resale, auction, estate, or tax purposes.
• May be materially inaccurate depending on item condition, provenance, market fluctuations, and the limitations of AI image analysis.

Always obtain a professional appraisal from a certified gemologist or jeweller for insurance, resale, or legal purposes.

Acceptable Use

You agree not to use Treasure Me to:

• Upload images that are unlawful, obscene, defamatory, or infringing on third-party rights.
• Attempt to gain unauthorised access to the App's backend, databases, or another user's data.
• Reverse engineer, decompile, or disassemble any part of the App.
• Use the App in any way that violates applicable local, national, or international law.
• Probe, scan, or test the vulnerability of our systems.
• Upload images of other people's clothing or personal items without their knowledge and consent, particularly in contexts where this could constitute surveillance or a privacy violation.
• Attempt to circumvent the free-tier item limit or subscription entitlements by creating multiple accounts.

Intellectual Property

The Treasure Me app, including its name, logo, design, user interface, code, and all original content, is the intellectual property of Camilla Sadyrova and is protected by copyright, trademark, and other applicable laws.

Your wardrobe data, jewellery records, outfit compositions, uploaded images, and any other content you create within the App belong to you. We claim no ownership rights over your personal data or images.

Nothing in these Terms grants you any right to use the Treasure Me name, logo, or branding in any way without prior written consent.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted or error-free.

We do not warrant that:

• The App will be available at all times or free from technical errors or interruptions.
• AI tagging, outfit generation, or jewellery identification will be accurate in all cases.
• Data stored via Supabase or our backend will never be lost (though we maintain regular backups).

To the extent permitted by law, we disclaim all implied warranties. Nothing in these Terms excludes any statutory rights you may have under applicable consumer protection law (including but not limited to Australian Consumer Law, EU consumer rights, or the UK Consumer Rights Act).

Limitation of Liability

To the maximum extent permitted by applicable law, Treasure Me's total liability to you for any claim arising from your use of the App — whether in contract, tort, statute, or otherwise — is limited to the amount you paid for the App or subscription in the 12 months immediately preceding the claim.

We are not liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Loss of data, loss of profits, or business interruption.
• Any financial loss arising from reliance on AI-generated jewellery valuations for insurance, resale, or other financial purposes.
• Any purchasing decisions made in reliance on GoodBuy Check or duplicate scanner results.
• Loss or corruption of uploaded images or wardrobe data due to third-party infrastructure failure (Supabase, Railway).

This limitation does not apply to liability for death or personal injury caused by negligence, or to any other liability that cannot be excluded by law.

Apple-Specific Terms

The following terms apply in addition to all other terms and are required by Apple's App Store Review Guidelines:

• Acknowledgement: You and Treasure Me acknowledge that these Terms are between you and Treasure Me only, not with Apple. Apple is not responsible for the App or its content.
• Scope of Licence: The licence granted to you for the App is a limited, non-transferable licence to use the App on any Apple-branded products you own or control, as permitted by the App Store Terms of Service.
• Maintenance and Support: Treasure Me is solely responsible for providing maintenance and support for the App. Apple has no obligation to provide any maintenance or support services.
• Warranty: In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.
• Product Claims: Treasure Me, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including: product liability claims; claims that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.
• Third-Party IP Claims: In the event of a third-party claim that the App infringes that third party's intellectual property rights, Treasure Me, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Changes to the App and Terms

We reserve the right to modify, suspend, or discontinue any feature of Treasure Me at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the service.

We may update these Terms from time to time. When we make material changes, we will notify you within the App or by email at least 14 days before the changes take effect. Continued use of the App after that date constitutes acceptance of the revised Terms.

The most current version of these Terms will always be available at this URL and within the App.

Age Requirement

You must be at least 13 years of age to use Treasure Me. If you are between 13 and 17 years of age, you may only use the App with the consent and supervision of a parent or legal guardian, who accepts these Terms on your behalf.

By using the App, you represent that you meet the age requirement described above.

Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles.

Any dispute arising out of or in connection with these Terms that cannot be resolved by good-faith negotiation will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
